Driver’s Responsibilities

To use the Frayt Services as a Driver, you must meet the qualifications provided below and comply with the following requirements as well as the Frayt Terms of Use, Privacy Policy and Delivery Agreement Terms.

 

Applying to be a Driver

By submitting a request to use the Frayt Services as a Driver, you expressly represent and warrant:

  1. You are 21 years of age or older;
  2. You are able to lift and carry Items that may be up to or exceed 50 pounds;
  3. You possess a valid driver’s license and are authorized to operate a motor vehicle;
  4. You own, or have the legal right to operate, a motor vehicle that: (i) was manufactured no earlier than 2008; (ii) is in good operating condition; and (iii) meets the industry safety standards and all applicable statutory and state department of motor vehicles or highway patrol requirements for a vehicle of its kind;
  5. All the information provided in your Driver application is truthful and honest;
  6. You understand that Frayt may, but is not required, to perform a consumer background or credit check and that you may be required to enter into a consumer background check authorization agreement before you are permitted to operate as a Driver on the Frayt Services; and
  7. You understand that Frayt may refuse to accept or may cancel your status as a Driver at any time in its sole discretion.

 

Using the Services

When using the Services, you agree:

  1. All information you provide to a Customer or other Frayt user regarding your qualifications or suitability for a particular job, incidental or additional delivery fees, and delivery times are truthful and accurate;
  2. To use reasonable precautions before entering into a Delivery Agreement, sharing personal information or otherwise interacting with a Driver or other Frayt user;
  3. To use any information, including personal information you learn about a Customer only as necessary to perform your obligations under a Delivery Agreement;
  4. You may not make any representations regarding Frayt, a Match, a Delivery Agreement, your status as a Driver or the Services;
  5. You are operating as an independent contractor and have not entered into any employment, partnership, agency or other similar relationship with Frayt; and
  6. You may not attempt to solicit a Customer away from Frayt to work with you outside of the Service.  If Frayt discovers you have been attempting to solicit Customers to work off the platform, your access to the Services will immediately be terminated and Frayt will pursue full recourse under applicable law.
  7. Customer will be charged a “Detention Fee” at a rate of $1/min for every minute beyond an initial 15 minutes you are required to wait at a pickup OR drop off location. Wait times for pick-up and drop off will be counted separately and will not be aggregated.  Frayt will collect the Detention Fees and reimburse you at a rate of 75% of the Detention Fees collected.  The Detention Fees will not be charged if you are late for a properly scheduled pickup.  If you have been waiting at a drop off or pickup location for more than two hours, you must leave the location unless and until you receive written authorization to continue to wait.  Please contact Frayt if you are required to leave a pickup or drop off location and we can assist you with next steps.

 

You are strictly prohibited from the following:

  1. Entering the business or dwelling of a Customer;
  2. Allowing any Customer to enter any part of your vehicle;
  3. Providing Customers with any services not provided for in a Delivery Agreement;
  4. Entering into any agreement or otherwise contacting Customers off of the Frayt app;
  5. Communicating, stalking, hassling, messaging or otherwise interacting with any Customer except as reasonably necessary to fulfill your obligations under a Delivery Agreement;
  6. Offering or providing transportation or moving service for profit, as a public carrier, moving company, or taxi service, charge for hauls or services or otherwise seek non-voluntary compensation from Customers, or engage in any other activity in a manner that is inconsistent with your obligations under the Agreement.
  7. Transporting Items across international borders.
  8. Driving in excess of six hundred miles per day;
  9. Using vehicles other than those approved by Frayt in your registration application.  You certify that the vehicle you use is the same vehicle which was inspected and photographed by you during the Frayt application process or otherwise during the term of the Agreement.
  10. Discriminating or harassing anyone on the basis of race, national origin, religion, gender, gender identity, physical or mental disability, medical condition, marital status, age or sexual orientation, or for any other reason, or in violation of any applicable law, rule or regulation.
  11. Transporting any of the following: accounts, bills, debts, evidence of debt, letters of credit, passports, documents, railroad or other tickets, notes, money, securities, currency, bullion, precious stones, jewelry and/or other similar valuable articles, paintings, statuary and other works of art, manuscripts, mechanical drawings, live animals, tobacco, cigars, cigarettes, non-ferrous metal in scrap and/or ingot form, or furs and skins; and
  12. Allowing any third-party to perform all or part of your obligations under a Delivery Agreement.

 

Insurance

Driver expressly represents and warrants the following regarding its insurance coverage:

 

  1. Driver shall maintain at its own expense, insurance policies with the following minimum coverages and limits: (i) automobile liability insurance per the following schedule for any vehicle used by Driver to provide services under any Delivery Agreement and naming Driver as the operator of the vehicle:  

 

Drivers are required to carry auto insurance limits as follows:

  • Vehicles less than 10,000 GVW - state minimum limits*
  • Vehicles 10,000 to 20,000 GVW - $300,000 combined single limit.
  • Vehicles 20,001 to 26,000 GVW - $500,000 combined single limit.
  • Vehicles 26,001 to 45,000 GVW - $750,000 combined single limit.
  • Vehicles greater than 45,000 GVW - $1,000,000 combined single limit.

*All Florida domiciled drivers are required to carry at least $25,000 Bodily Injury Per Person / $50,000 Bodily Injury Per Accident / $25,000 Property Damage.

 

Frayt reserves the right to require you to provide proof of insurance at any time.

 

  1. Driver shall name Frayt as an additional insured on its insurance policy;
  2. If a claim is filed with Frayt’s insurance provider or Frayt is otherwise required to pay for damages caused by Driver, in Frayt’s sole discretion, Frayt may charge your Account for any or all of the deductible Frayt is required to pay, or actual expenses incurred by Frayt as a result of such claim;
  3. In the event of any claim or motor vehicle accident, Driver will be solely responsible for reporting such accident in compliance with applicable law and your insurance policy.

 

You understand that you will be exclusively liable for any injuries or damages that result from your failure to comply with these obligations.  You may also be prohibited from using the Frayt Services or face other legal consequences if you fail to comply. 

 

You also will indemnify and hold harmless Frayt and any shippers we match you with, from and against any and all liability, by reason of accident, injuries, or negligence of any kind that may result from you while performing deliveries on the platform.
